When a preventive review makes sense
- The person has received an arrest warrant or credible notification of a foreign criminal proceeding.
- An extradition request has been threatened or transmitted through national channels.
- There are documents indicating a political, discriminatory or private-dispute dimension to the matter.
- An earlier Red Notice or diffusion was removed and there are credible indications of renewed data circulation.
- The person needs to understand whether an access request, a compliance submission or national-counsel action should be considered first.
A rumor or a search result saying that someone is 'on the INTERPOL list' is not proof that INTERPOL data exists. Equally, the absence of a name on the public Red Notice website is not proof that no private data are processed.
Preventive options: what each one can — and cannot — achieve
| Option | Potential role | Important limit |
|---|---|---|
| CCF access request | Seek information about data potentially held in INTERPOL's Information System | Disclosure can be restricted and a negative public search is not determinative |
| Evidence preservation | Create an authenticated chronology and source-document set before an emergency arises | Does not itself prevent a notice or diffusion |
| CCF correction/deletion request | Challenge identifiable INTERPOL data within the CCF's mandate | The CCF is not a court that quashes a national warrant |
| Contact with national defence counsel | Address warrants, detention or extradition risks under domestic law | Decisions depend on the specific jurisdiction |
| Future-data monitoring plan | Review reliable new information and formal communications | No private firm can provide live access to a complete INTERPOL database |
What the legal team reviews
We separate the national proceeding from the INTERPOL data question. A complaint about fraud may involve a genuine criminal allegation, a predominantly private dispute, or both; the relevant documents—not the label chosen by either party—determine what may be argued. For political and human rights issues, we identify evidence connecting alleged misuse to the individual case.
The initial review usually focuses on the alleged offence, date and validity of any warrants, known procedural history, extradition activity, previous CCF applications, and any protection status. We also record which details are first-hand evidence and which are unverified reports.
Preparation checklist
| Document | Reason to collect it |
|---|---|
| Warrant, summons or indictment | Establishes the exact procedural status and allegations |
| Court decisions and official notifications | Shows changes in proceedings and available remedies |
| Extradition correspondence | Helps distinguish national risk from INTERPOL processing |
| Refugee or other formal protection decision | May be material to the applicable INTERPOL protection framework |
| Source-country evidence and translations | Supports a specific, rather than generic, compliance argument |
| Previous CCF decision or portal correspondence | Helps avoid duplicate or procedurally defective applications |
How CIL structures the preventive review
- Scope — identify what is known, what is suspected and what lies outside the CCF's jurisdiction.
- Evidence map — organise records by issue: purpose, accuracy, neutrality, protection status and procedural validity.
- Route selection — consider an access request, a carefully framed data challenge where appropriate, and parallel domestic action.
- Prepared response — compile an updatable chronology, translated documents and decision-ready instructions for local counsel.
- Reassessment — reconsider the approach when a new official warrant, CCF communication or extradition decision emerges.
Frequently asked questions
Can a lawyer stop INTERPOL from publishing a future Red Notice?
There is no universal 'pre-clearance' or guaranteed veto. The appropriate strategy depends on whether data exists, the applicable rules and the available evidence. Do not assume the CCF will decide a hypothetical national criminal dispute.
Can I send a preventive letter by ordinary email?
Since 26 March 2026 the CCF's dedicated online portal is the required submission channel for requests, subject to exceptional alternative means permitted under Rule 25(2). Whether any proposed submission is admissible requires a case-specific review.
Will this remove a domestic arrest warrant?
No. CCF remedies concern INTERPOL data processing. National courts and authorities control domestic warrants.
