Urgent CCF Provisional Measures for INTERPOL Cases

If you are detained, facing an imminent extradition hearing or have evidence of immediate harm caused by INTERPOL data, the priority is to act on the correct legal fronts. Contact a qualified local criminal or extradition lawyer immediately. A CCF request does not replace national-court remedies.

If you are detained right now, instruct a local criminal or extradition lawyer in the country where you are held. A request to the CCF concerns INTERPOL’s data; it does not replace the national proceedings that decide on your detention or extradition.

The CCF may adopt provisional measures in relation to data during the examination of a request under Article 37 of its Statute. Their availability depends on the particular record and urgency; they are not automatic.

What may justify urgent assessment?

What provisional measures may do

The CCF may decide on temporary data-related measures while the merits of an application are being examined. Such a measure is distinct from a final deletion decision, and its practical implications need to be checked. It does not automatically reverse a national detention order or close an extradition file.

Immediate information to prepare

  • Your current country and whether you are in custody.
  • The next hearing or deportation/extradition deadline, including local time.
  • The name and contact of your local lawyer, if any.
  • Any Red Notice or diffusion reference that is already known.
  • The exact urgent document (court order, notice, custody record), shared only through a secure channel.

What CIL can coordinate

  1. Rapidly separate INTERPOL-data issues from local judicial powers.
  2. Assess the basis and documentary support for any CCF application.
  3. Seek data-related interim measures where justified under the CCF's framework.
  4. Coordinate factual positions with authorised local counsel to avoid contradictions.
  5. Follow the CCF correspondence and advise on longer-term deletion or diffusion challenges.

FAQ

Can the CCF order my release?

The CCF's mandate concerns INTERPOL's processing of data, not the power of a domestic court to order release. Your local lawyer must address detention or extradition locally.

How quickly does the CCF grant an urgent measure?

There is no reliable fixed decision time for an individual urgent request. Never plan around a promised response date.

Must I wait until the deletion decision?

Possible provisional measures can be considered during the examination of a request, where the circumstances justify them.
