Political Red Notices: Challenging Misuse of INTERPOL

Article 3 of INTERPOL's Constitution prohibits the organisation from undertaking activities or interventions of a political, military, religious or racial character. That safeguard can be relevant where a person faces a criminal accusation in the context of opposition activity, journalism, activism or political conflict.

A political background does not automatically make every case impermissible. The CCF examines the complete circumstances, including the nature of the offence, the individual's status, the source state's position and the broader context.

Indicators that may warrant deeper review

  • Prosecution begins soon after opposition activity or public criticism.
  • Allegations are accompanied by official rhetoric tying the person to political dissent.
  • Comparable conduct is treated differently depending on political affiliation.
  • Courts or independent bodies have documented procedural irregularities or retaliation.
  • Credible country evidence shows a pattern of misuse of criminal justice mechanisms.
  • The requesting state seeks information about a journalist, dissident or activist in a way that raises neutrality concerns.

Article 3 is not the only rule

Human-rights concerns may also arise under Article 2 of INTERPOL's Constitution and the applicable data-processing rules. The most appropriate submission may combine distinct arguments, provided each is supported by factual evidence. Overstating motives without demonstrating their connection to the prosecution can weaken an otherwise credible application.

Our assessment process

  1. Reconstruct the timeline of political activity and the criminal complaint.
  2. Distinguish verifiable events from allegation or speculation.
  3. Map the relevant factors against INTERPOL's neutrality requirements.
  4. Assess whether recognised refugee status or other protection decisions are relevant.
  5. Determine whether to pursue deletion, access or an appropriate revision.

FAQ

Can an opposition politician never be subject to a Red Notice?

No. The CCF examines whether the INTERPOL activity is impermissibly political in its overall character, not merely whether the individual is politically active.

Is an asylum application sufficient?

Not automatically. A pending application and a recognised protection decision have different legal implications, which must be assessed in context.

Will the CCF decide that the domestic prosecution is unlawful?

The CCF's mandate concerns compliance of INTERPOL data, rather than giving a general ruling on domestic criminal guilt or the legality of national proceedings.
