CCF Deletion Requests: Challenge INTERPOL Data

A request for deletion asks the Commission for the Control of INTERPOL's Files (CCF) to determine whether personal data in INTERPOL's systems comply with the organisation's rules. It is not a criminal appeal and cannot itself set aside a national arrest warrant. It is a distinct, document-driven procedure with its own tests and evidentiary requirements.

CIL prepares applications that explain the specific rule engaged, the decisive facts and how each supporting document answers the relevant issue.

When might deletion be available?

Potential concernWhat the CCF may need to examine
Political characterPurpose, context, status of the person, alleged offences and applicable neutrality rules
Human rightsReliable facts about proceedings, treatment risks and applicable human-rights protections
Commercial/private disputeWhether a criminal allegation contains sufficient criminal elements rather than simply non-payment or contract breach
Data accuracyWhether the alleged conduct, identity, legal basis and status are sufficiently clear and current
Subsequent judicial developmentsWhether a later order changes the lawfulness or relevance of the data

These categories do not operate automatically. For example, an extradition refusal may be relevant but does not invariably invalidate a Red Notice.

What a persuasive application contains

  • A short statement of the relief requested and the specific data at issue, if known.
  • A chronology with dates of key events, proceedings and decisions.
  • A neutral description of the underlying criminal allegations.
  • A rule-based analysis, distinguishing provable facts from inferences.
  • A numbered index of annexes and certified translations when needed.
  • A list of any urgent risks and grounds for interim action.

The CCF deletion procedure

  1. Admissibility. The formal requirements must be met, including identity and authority documents where applicable.
  2. Written review. The CCF may request further information from the applicant, INTERPOL or the data source.
  3. Determination. The CCF decides whether the data processing complies with the relevant rules.
  4. Implementation and notification. Where corrective action is ordered, implementation and notification follow the Commission's procedures.

The statutory decision period for deletion is nine months after a request becomes admissible, but extensions are possible. Treat any expected completion date as an estimate, not a guarantee. New requests are submitted through the official portal, subject to the exceptional-circumstances rule.

Deletion, blocking and correction are different

MechanismRoleWhat it does not do
DeletionRemoves non-compliant data from INTERPOL's systems after a decisionAutomatically erase every domestic record or warrant
CorrectionAmends personal data where a correction is appropriateDecide the criminal merits
Provisional measureMay restrict processing while a request is examinedGuarantee final deletion

If immediate detention or extradition is at issue, see provisional measures.

FAQ

Can I file without a lawyer?

The CCF accepts applications from individuals and their duly authorised representatives. Legal assistance can be useful where the record is complex or the grounds require careful substantiation.

What if the country objects to disclosure?

Disclosure may be restricted under the CCF's rules. The reasons and available response depend on the file.

Does deletion end the national prosecution?

No. Domestic judicial and police decisions are separate and may require additional legal work.
